General terms and conditions of business

§ 1 Scope
The following General Terms and Conditions (GTC) apply to all orders placed via this website.

Our range of goods is aimed exclusively at consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).

§ 2 Warranty / Guarantee
Unless expressly agreed otherwise below, the statutory liability for defects applies. As a buyer, you are asked to check the goods immediately upon delivery for completeness, obvious defects, and transport damage and to notify us of complaints as soon as possible. Failure to do so will not affect your statutory warranty claims.
Manufacturing defects such as silicone streaks or residue may be visible. Glass overhangs are within the tolerance range up to half of the glass thickness used.
Air inclusions may be present in bead and butt joint adhesives. Aquariums from Terra-Natur come with a 2-year manufacturer's warranty.

§ 3 Liability
The seller is not liable for damages caused by simple negligence by him, his legal representative, or his vicarious agent. This applies regardless of the legal nature of the asserted claim, in particular from delay, other breach of duty, or tort. This limitation of liability does not apply to damages resulting from injury to life, body, or health and from the breach of essential contractual obligations.

§ 4 Prices
Unless otherwise stated in the seller's product description, the prices quoted are total prices including all relevant taxes.

§ 5 Retention of Title
We reserve ownership of the goods until full payment of the purchase price.

§ 6 Conclusion of Contract
Offers contained in brochures, advertisements, social media, messengers or other platforms – also with regard to price information – are subject to change and non-binding.
We are bound by individually prepared written offers that a customer usually receives by email for 30 days.
Ancillary agreements, changes, and additions to a contract should be agreed upon in writing.

The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract, but merely a non-binding invitation to the customer to place an order.
By submitting the order, the customer makes a binding offer to conclude a purchase contract. The order confirmation or receipt confirmation automatically sent immediately after receipt of the order only confirms receipt of the order and does not yet constitute acceptance of the offer.
A purchase contract is only concluded when we expressly accept the order by a separate order confirmation, send a payment request or invoice, or ship or deliver the ordered goods to the customer.

§ 7 Payment Methods
In principle, the following payment methods are available to you:
– Cash payment upon collection
- Bank transfer

§ 8 Delivery, Delivery Times and Shipping Conditions
The delivery times for mail and parcel shipments are usually 2-3 working days. We count Monday to Friday as working days.
If the deadline falls on a Sunday or a public holiday at the place of delivery, the deadline ends on the next working day.

The delivery of goods takes place by shipping to the delivery address specified by the customer, or by handover by us to the customer in the case of self-collection.

The delivery times for parcel & freight forwarding goods such as aquariums, substructures, etc. are noted in the individual offers. Production-related deviations may occur, especially for custom-made products.

§ 9 Dispute Resolution
The EU Commission provides a platform for online dispute resolution on the internet at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
